In order to be an effective lawyer, one has to know people, understand their motivations and comprehend, in every facet, what it is that a client is desirous of achieving and the most efficient and cost effective way of accomplishing that end.
 
In order to be an effective lawyer, one has to anticipate the unexpected and be able to "see around corners”. Anybody can see something coming straight at them. It is the ability to predict and prepare for contingencies that distinguishes one lawyer from another.
 
Only with an understanding of people, the legal process and the associated costs, can a lawyer be truly effective in dealing with a legal problem or issue. Only then can a lawyer really provide a client with the greatest benefit at the most advantageous cost to the client. An understanding of these matters must be in the forefront of your lawyer’s mind at all times. Cost is an issue now more than ever. Nobody wants to waste money.
 
Every client is important. No client is just a number. No file is "just another file". The relationship between a lawyer and his client is a very special one; it is a professional relationship imbued with fiduciary responsibilities, confidentiality and, should, involve a very high level of concern from the lawyer toward the client. Generally speaking, a client comes to a lawyer in a state of distress. It is the responsibility of the lawyer to be sensitive to the client’s circumstances and to be a passionate advocate of the client’s rights. It should be a privilege and an honour for the lawyer to serve the interests of the client. If the client is not sensing that, then the client might be better served elsewhere.
 
David Himelfarb is a caring, effective, legal practitioner and strategist. David received his Bachelor of Laws degree from the University of Windsor in 1979 (receiving a Gold Medal for Special Achievement in his graduating year) and was called to the Bar of the Province of Ontario in 1981. He was called to the Bar of the State of California in 1986. While practicing, David also received his Master of Laws degree in 1999 from Osgoode Hall Law School.
 
David’s varied law practice includes a wide range of business, corporate, litigation and entertainment matters, including the following:

  • preparing and negotiating employment contracts
  • Intellectual property matters, including trademark and copyright matters, confidentiality agreements, distribution agreements, licensing agreements
  • Conflict resolution in general litigation and family law matters
  • Advising entrepreneurs and owner-operated businesses as to general legal and business issues
  • Commercial transactions in the entertainment business, including matters relating to: film, television, music, stage performances, live touring, taxation, licensing and sponsorship agreements related thereto
  • Immigration matters, including working with U.S. counsel in obtaining waivers, visas, and other legal documents pertaining to working and residing in the United States
When not otherwise busy with his practice, David enjoys tennis, golf, skiing, snowboarding, sailing, rollerblading, attending comedy festivals and producing entertainment projects for some of his celebrated clients
